Please read these terms and conditions carefully, since they, along with the other relevant information on our website, set out the terms and conditions which will apply to you when you book any apartment accommodation through our website

Bookings made through www.whisperingsandsholidays.com do not and cannot constitute a ‘package’ (as defined by the Package Travel, Package Holidays and Package Tours Regulations 1992) and these Regulations do not apply.

Definitions

In these terms and conditions, the following definitions apply unless the context otherwise requires.
“Arrangements” means the apartment(s) or any other service you book through us.
“Booking” means your booking with www.whisperingsandsholidays.com “Conditions” means these terms and conditions.
“www.whisperingsandsholidays.com ”, “we”, “us”, “our” and “ourselves” means Whispering Sands Holidays
“You” and “your” means all persons (or any of them as applicable) named on your booking (including the person who makes the booking and anyone who is added or substituted at a later stage).

Making a booking

The person who makes the booking must be at least 18 and is responsible for payment of the total cost of the booking, including cancellation or amendment charges that may be payable. He or she also agrees to provide accurate and full information to the remainder of the party in relation to the booking, and by confirming the booking, confirms that all the other members of the party, including any that are added or substituted at a later date, agree to be bound by these conditions and all other information on our website.

Holiday Extras; Please note that any holiday extras, such as airport transfers,., that you book through our on-line website www.whisperingsandsholidays.com or by email or by telephone will be payable in full 6 weeks prior to your arrival.

Confirmation of Booking

If you book through an agent, your booking confirmation will be emailed to you by your agent. If you book with us direct, either by our website or phone, you will receive a confirmation email detailing the contract. A binding contract between you and Whispering Sands Holidays for any accommodation booked and for any other service booked will come into existence when your confirmation itinerary is emailed. Prior to doing so, we may email you an acknowledgement of your booking. Any such acknowledgement simply confirms that we are dealing with your booking request and is not a confirmation of it.
Please check your confirmation itinerary together with all other information and documents we send you as soon as you receive them. Contact us immediately if any information which appears on your confirmation itinerary or elsewhere appears to be incorrect or incomplete as it may not be possible to make changes later. We regret that neither we nor any other service provider can accept any responsibility if we are not notified of any inaccuracies in any document within 14 days of our sending it out. We will do our best to rectify any inaccuracies notified outside these time limits. However, you will be responsible for any costs and expenses involved in doing so except where we/the service provider made the mistake and there is good reason why you did not contact us within the time limit.
When you or your agent makes a booking verbally, electronically or in writing we will send you our written confirmation invoice and a contract is made. At the time of booking you will be asked to pay a non refundable deposit and consent to our processing personal information about you and other members of your party. The balance of your holiday must be paid 6 weeks prior to your arrival date. Please ensure that the final balance is paid by the date shown on your invoice as failure to do so may result in your holiday being cancelled. If you book through an agent all monies you pay to the agent are held by the agent on our behalf at all times. The Law of Turkey will govern the contract between you and us.

After a Booking is Confirmed

If you have booked through us direct, we may communicate with you by email, by post or by telephone. If you booked through an agent, all communication will be sent by your agent. By making your booking or enquiry via the internet or otherwise providing us with an email address, you authorise us/the service provider to contact you in relation to your booking or enquiry using the email address you have used to contact us or which you have otherwise provided. You must accordingly check your emails on a regular basis. Not all communications can go by email. We/the service provider may also contact you by post or by telephone if, for example and for whatever reason, we have difficulty contacting you by email or we/the service provider urgently need a response from you.

Confirmation Page

If you have booked through us direct you should print and bring all pages of the emailed itinerary. These will be sent to you shortly after booking online, (along with any accompanying and or confirmation of additional services you have booked through us.) All pages of the itinerary should be presented along with your passport and any relevant travel documents at arrival. Failure to do so may result in you being denied accommodation. Please ensure you check your travel details and the important information on the itinerary and remember to check your email for any changes.
You risk being unable to obtain accommodation without this documentation and we shall not be responsible for any consequences of accommodation being refused.

Travel Insurance

The cost of travel insurance is not included in any of the charges we apply to you for your holiday. We strongly advise you to take out insurance suitable for your needs before you travel. We cannot be responsible for any costs you incur as a result of you failing to do so. We shall not be liable to you for death or injury or loss or damage to you or your property unless due to negligence and/or failure on our part to perform our obligations under this agreement or under the general law. Nor shall the owner of the property be liable to you for any of the aforementioned during any period of occupancy of the property. It is your responsibility to supervise your children whilst they are in or near the swimming pools.
For your own peace of mind the insurance should cover you if you have to cancel your flight or other holiday arrangements and for any emergencies which arise while you are away. Please read your policy details carefully when you receive them and take them with you when you travel.

Cancelling a Booking

You or any member of your party may cancel your travel arrangements at any time. We must receive an email notification from the person who made the booking or your agent on your behalf. If you wish to cancel your holiday this must be done in writing from the person in whose name the holiday is invoiced (or the agent through whom the booking was made). This is effective from the date it is received at our office. This email must be sent to the same email address that was used at time of booking, unless we have subsequently advised you of a different email address to use.

In the event of cancellation or part cancellation the following charges are payable:
a) Cancellation up to 6 weeks before arrival will result in loss of deposit only.
b) Cancellation within 6 weeks of arrival will result in loss of 100% of booking.

Disability

In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements we need to use the information you provide (such as name, address, any special needs etc.) We take full responsibility for ensuring that proper security measures are in place to protect your information. The information may also be provided to public authorities such as customs/immigration if required by them, or as required by law. Additionally, where your holiday is outside the European Economic Area (EEA), controls on data protection in your destination may not be as strong as the legal requirements in the UK. We will however, only pass information onto persons responsible for part/all of your travel arrangements. This applies to any sensitive information that you give to us such as details of disabilities. (In making this booking, you consent to this information being passed on to the relevant persons). You have a right of access to data held by us.

Marketing

We will hold information, where collected by us, and may use it to inform you of offers in the future or to send you brochures. If you do not wish to receive such approaches in the future, please advise us.
Check-in Time
• You may check in after 15:00
Check-out Time
• You must check out before 12:00
Should you require any change to these times, please send us an email with the details. We will then advise if a variation is possible and if any additional cost is payable.

Air Condition

The air condition in your apartment is very robust and will cool/heat the apartment quickly. It is best to have a temperature between 19 and 23 degrees for comfortable living. Please do not leave the air condition running when you leave the apartment each day, as this is a waste of power and energy.

Non-Smoking

Whispering Sands is a Non-Smoking Resort.
Smoking is permitted only in designated outdoor smoking zones and on the balcony of your apartment. It is not permitted to smoke inside the apartments.

Pets

Pets are not permitted within the resort.

Maximum Occupancy

The maximum number of guests permitted to stay in the apartment is as follows:
• 2 bedroom apartment; maximum 6 persons
• 4 bedroom apartment; maximum 9 persons

Security Deposit

A Security/Damage deposit may be required from you. Any payment required will be notified to you on your booking invoice. This money is not applied to your rental commitment and will be returned in full to you within 14 days of your departure provided the following provisions are met:
• No damage is done to property or contents, beyond normal wear and tear.
• No charges are incurred due to illegal activity, collection of rents or services rendered during your stay.
• All keys have been returned to Reception prior to your departure.
• Any and all charges accrued during your stay are paid prior to your departure.
• No linens/towels are lost or damaged.

Daily Housekeeping

While linens and towels are provided for your arrival, daily housekeeping service is not included in the rental rate. However, it is available at an extra charge. We suggest you bring beach towels as we do not permit towels and linens to be taken from the apartment.

Water & Septic

Although the water in the apartment has been filtered a number of times before arriving at the faucets, it is advisable to drink only bottled water which is readily available on site.
The septic system is very effective; however it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that your failure to comply with this rule has caused the system to be blocked, then you could be charged damages up to £250.

Unused Services

There will be no refund made for any unused services paid for during your stay at Whispering Sands if not all used during your holiday. Early departure will not warrant any refund of rent.

Website Accuracy

Things may change and errors may occur after information is placed on our website. We check regularly to see if we need to update or correct any information or prices. If there are any significant information changes or we find any mistakes, we will put updated details on our website so you will receive the latest information when you make your booking. If you have already booked, we will do our best to let you know about any significant changes or mistakes which affect you before you travel. The price payable for your arrangements is the one shown on our website which, by making a booking, you have agreed to pay.
Whilst every effort is made to ensure the accuracy of all information and prices displayed on this website, regrettably errors may occasionally occur. In the event that an incorrect price has been entered in error, any booking made based on such incorrect price will not be valid so far as the arrangements affected are concerned. You will be advised of the mistake at the earliest opportunity and you will then have the option to either pay the correct price or cancel the affected arrangements and receive a full refund of any money you have already paid for them.
